Eluta Terms of Service

Use of this website (the “Site”) is conditional on the terms and conditions set forth below. By accessing or using materials from the Site, you agree with Mediacorp Canada Inc. (“Eluta”) to abide by these terms and conditions on behalf of yourself and any entity for which or whom you may act. If you do not agree to these terms and conditions, you should not use the Site or materials from it.

Acceptable Use Policy

Personal and commercial users may browse, receive email notifications and subscribe to RSS feeds from the Site without prior written authorization. Website owners may incorporate RSS and OpenSearch feeds from the Site into their websites only if three prior conditions are met: (a) their site does not display adult content, illegal materials or pages consisting mainly of sponsored links; (b) the code for our RSS or OpenSearch feed is used without alteration, so that end-users always are directed to the Eluta page describing each position; and (c) they do attempt to compile data from our Site for publication, whether online or in print. Under no circumstances are you permitted to copy materials that appear on the Site or store the information from the Site in a database or other data retrieval service. All other uses of the Site require prior written authorization from Eluta.

Third Party Content

Eluta does not control the content of third-party sites that are included in its search results. Linked pages may change or disappear entirely for reasons beyond Eluta’s control. Eluta assumes no responsibility for linked job opportunities, websites or other content included in its search results.

Copyright & Intellectual Property

You agree not infringe the copyright owned or licensed by Eluta in the search results, employer descriptions, directory information and related content found on the Site. You agree to respect all intellectual property rights that Eluta holds in the Site, including any trade marks or copyright material that Eluta may own or license. The Site’s proprietary search algorithms and other processes are the exclusive intellectual property of Eluta. You agree not to decompile or reverse-engineer such algorithms or processes to influence the page rankings that Eluta assigns to search results on the Site.

Editorial Content

Eluta owns or licenses the copyright in the extended editorial content that is presented with its search results. This content includes employer descriptions, excerpts of job listings, employer reviews, descriptions of employer benefits, extracted salary information and statistical compilations offered to assist users in finding suitable employment. While Eluta strives to ensure the accuracy of this editorial material, it cannot guarantee its accuracy and takes no responsibility for errors. Eluta reserves the right to correct, change, replace or delete any of this editorial content at any time and without notice to the user.

Changes to Services

Eluta may modify, change or terminate all and any services on the Site without notice to you or liability. This may include imposing limits on your access to the Site (or denying access altogether), adopting download restrictions or instituting other measures that Eluta in its sole judgment deems necessary or desirable.

No Warranties

Eluta makes no representation or warranties as to the accuracy, completeness or timeliness of information appearing on the Site, all of which is provided on an “as is” basis. ELUTA EXPRESSLY DISCLAIMS ALL REPRESENTATIONS, WARRANTIES AND CONDITIONS INCLUDING WITHOUT LIMITATION ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, NON-INFRINGEMENT OF PROPRIETARY RIGHTS AND FITNESS FOR A PARTICULAR PURPOSE AND THOSE ARISING BY STATUTE OR OTHERWISE IN LAW OR FROM A COURSE OF DEALING OR USAGE IN TRADE. In operating a search engine, Eluta does not control or warrant the accuracy, content or reliability of information prepared by third parties. Such information is included in Eluta’s search results without warranty or representation solely to assist users in locating web pages that announce new job opportunities. By its nature, this information can be incorrect, inaccurate, offensive or even harmful to the user. Furthermore, such information may be incorrectly labeled or falsely labeled in such as way as to cause you damages or losses. Eluta does not verify that parties whose job opportunities are included in its search results are who they claim to be. Eluta has no control over, and will not be responsible for, employment and hiring decisions made by employers whose job opportunities are included in Eluta’s search results. Your use of the Site, and all information found on it, is done at your own risk. You release Eluta, its licensors and third parties mentioned on the Site from all claims and damages relating to your use of the Site. Eluta does not warrant that the Site shall continue to operate, operate without interruptions, operate in a secure fashion or that it will be free of errors.

Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL ELUTA, ITS LICENSEES OR ANY THIRD PARTY MENTIONED ON THE SITE BE LIABLE FOR ANY LOSS OR DAMAGES RELATED TO YOUR USE, MISUSE OR RELIANCE UPON THE SITE. This limitation of liability and disclaimer shall apply: (i) regardless of whether Eluta, its licensees or any third party mentioned on the Site has received actual or deemed notice that the possibility of such loss or damage exists; (ii) regardless of the form of action (whether contract, tort or otherwise), relief claimed or remedy sought; (iii) to all losses and damages claimed, whether consequential, direct, indirect, special or punitive; and (iv) regardless of the failure of any remedy or the “essential purpose” of these Terms of Service. You agree that you download files and other materials via the Site at your own risk and you will be solely responsible for any damages to your computer system or loss of data that results from such downloading. In any event, you agree that the maximum aggregate liability for all damages shall be limited to the sum of $100, even where multiple causes of action may exist. The parties agree that this limitation of liability clause has been included to permit the parties to fairly allocate risks between them and to make the Site free and accessible for as many users as possible. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR SPECIAL DAMAGES AND, WHERE THIS EXISTS, PORTIONS OF THIS LIMITATION OF LIABILITY MAY NOT APPLY TO YOU.


Eluta reserves the right to amend these Terms of Service from time to time without notice to you. After any such amendment, continued use of the Site will constitute acceptance of the amended Terms of Service. These Terms of Service constitute the entire agreement between the parties with respect to the Site and replaces all other agreements, whether written or otherwise, that relate in any way to the Site. Any waiver of, or release from, these Terms of Service shall not be binding on Eluta unless executed in writing by its President and General Counsel.

Governing Law & Miscellaneous

These Terms of Service are governed by the laws of Ontario and the federal laws of Canada applicable therein. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms of Service. If any of these Terms of Service is found to be unenforceable or invalid, the remaining provisions shall survive and remain enforceable. The headings in these Terms of Service are included for convenience of reference only.
